Filing a DMCA Takedown Notice

Required Elements

To file a valid DMCA takedown notice, you must include ALL of the following elements in your written communication:

1. Physical or Electronic Signature

A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.

2. Identification of Copyrighted Work

Identification of the copyrighted work claimed to have been infringed, including the title, author, any registration numbers, and URLs where the original work can be found.

3. Location of Infringing Material

Identification of the specific material that is claimed to be infringing, including sufficient information to locate the material (specific URLs, usernames, stream titles, etc.).

4. Contact Information

Your address, telephone number, and email address so that we can contact you regarding your complaint.

5. Good Faith Statement

A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

6. Perjury Statement

A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Counter-Notification Process

Filing a Counter-Notice

If you believe your content was removed by mistake or misidentification, you may file a counter-notification containing:

Required Counter-Notice Elements

Your physical or electronic signature; identification of the removed material; a statement under penalty of perjury that you believe the removal was a mistake; your name, address, and phone number; and consent to federal court jurisdiction.

Restoration Timeline

If we receive a valid counter-notification, we will forward it to the original complainant. If they do not file a court action within 10-14 business days, we may restore the removed content.

Filing a false counter-notification may result in legal liability. Consider consulting with an attorney before submitting a counter-notice.

Repeat Infringer Policy

Three-Strike System

HypeCrew operates under a progressive enforcement policy for repeat copyright infringers:

First Violation

Warning notification and temporary content restriction. The user receives education about copyright policies and a 7-day content review period.

Second Violation

30-day account suspension and mandatory copyright education completion before account restoration.

Third Violation

Permanent account termination. All content, streams, and associated data will be permanently removed from our platform.

Appeal Process

Users may appeal enforcement actions within 30 days. Appeals are reviewed by our legal team and may result in account restoration if the violation was found to be in error.

Restoration Window

Suspended accounts have a 90-day window to complete required education and submit successful appeals before permanent termination.
