By accessing or using HypeCrew ("Service", "Platform", "we", "us", or "our"), including our website, mobile applications, and AI-powered streaming companion services, you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations.

If you disagree with any part of these terms, you do not have permission to access or use the Service. These Terms apply to all visitors, users, subscribers, and others who access or use the Service.

HypeCrew provides AI-powered companion services for live streamers, including but not limited to:

• AI chatbot companions that interact with streamers during broadcasts
• Automated viewer engagement and chat moderation tools
• Stream analytics and performance insights
• Customizable AI personality configurations
• Integration with various streaming platforms
• Community features and networking tools for streamers

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice or liability.

3.1 Age Requirements

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. Users under 18 may only use the Service with parental or guardian consent and supervision.

3.2 Account Information

When creating an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Account Security

You must immediately notify us of any unauthorized use of your account or any other security breach. We will not be liable for any loss or damage arising from your failure to protect your account information.

You agree not to use the Service to:

• Harass, abuse, threaten, or intimidate other users
• Impersonate any person or entity, or falsely claim affiliation
• Engage in any activity that disrupts or interferes with the Service

• Use the Service for any illegal or unauthorized purpose
• Collect or harvest user data without permission
• Create multiple accounts to evade suspension or termination
• Use automated systems or bots without our express permission

5.1 AI Limitations

Our AI companions are automated systems designed to enhance streaming experiences. While we strive for accuracy and appropriate responses, AI systems may occasionally produce unexpected or inappropriate content. You acknowledge that AI responses are not guaranteed to be accurate, appropriate, or error-free.

5.2 User Responsibility

You remain fully responsible for all content generated or displayed during your streams, including AI-generated content. You must monitor and moderate AI companion interactions to ensure compliance with platform policies and applicable laws.

5.3 No Professional Advice

AI companions do not provide professional advice (legal, medical, financial, etc.). Any information provided is for entertainment purposes only and should not be relied upon for important decisions.

6.1 Your Content

You retain ownership of all content you create, upload, or stream using our Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of operating and improving the Service.

6.2 Our Content

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of HypeCrew and its licensors. The Service is protected by copyright, trademark, and other laws.

6.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Service becomes our property and may be used without compensation or attribution to you.

Your use of the Service is governed by our Privacy Policy, which details how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

We implement industry-standard security measures to protect your data. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

8.1 Subscription Plans

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law.

8.2 Automatic Renewal

Subscriptions automatically renew unless canceled before the renewal date. You can cancel your subscription at any time through your account settings.

9.1 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPECREW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

9.2 Total Liability Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless HypeCrew, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service
• Your User Content
• Your violation of any third-party rights
• Any harm caused to other users or third parties

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Termination does not entitle you to any refunds unless required by law.

11.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Request by law enforcement or court order
• Technical or security issues

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account and User Content, though some information may be retained as required by law or for legitimate business purposes.

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you disagree with the changes, you must stop using the Service.

These Terms shall be governed and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, and judgment on the award may be entered in any court having jurisdiction.

Notwithstanding the above, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.
